Typically, to succeed in a tort lawsuit, the victim must prove that the tortfeasor acted with substantial certainty that the injury would result. Though the wish to harm a person is not necessary, the tortfeasor must have been aware that his/her actions would lead to a particular injurious result. Examples of intentional torts include assault, battery, false imprisonment, intentional infliction of emotional distress, and trespass.
